SITE OPERATION AND PRODUCTION

The Website is operated by FRUTATION® and exists for the purpose of disseminating information about our company and our FRUTATION® arrangements and other products, and to providing a mechanism for users to order our FRUTATION® arrangements and other products online. 
This Website is hosted, and all information that you submit through this Website is collected, stored, and processed, in the United States.

INFORMATION GATHERED

Generally, we do not collect information that personally identifies individuals except when individuals knowingly and voluntarily provide such information to us.  For example, we will gather information about individuals when they submit comments, questions or requests for information to us on this Website.  We use information we receiver to operate and improve the content of this Website, and to provide the product(s), service(s) or information, or carry out the transaction(s) that you have requested or authorized.  We may share any of the information we gather on our Website or otherwise maintain with our affiliates, franchisees, and service providers (for more information please see the section entitled SHARING INFORMATION below).  We also collect personally identifiable information in the following ways and for the following purposes:

  • Accounts:  We permit our Website users to register for an FRUTATION® account for their personal use ("User Account") and/or for their organization’s use ("Corporate Account").  If you decide to register for a User Account or a Corporate Account (collectively, "Accounts"), you will be required to provide us with your name and contact information (including organization information for Corporate Accounts), and to choose a username and password.  For each Account, we will maintain and allow Account holders to view order history and order shipment status.  Account registrants may, but are not required to, provide us their credit card information for express checkout for orders on our Website (so that credit card information does not have to re-entered next time an order is placed from the Account); set up birthday or gift reminders within their Accounts; and create address book entries for recipients of the FRUTATION® arrangements or other products they order on this Website.  We will use this information to customize the experience on our Website.  We utilize industry-standard SSL technology to allow for the encryption of all Account registrations on our Website.  For additional details about our information security practices please see the section entitled SECURITY below.
     
  • Franchisee Applications:  We permit users who are interested in franchise opportunities with FRUTATION® to submit franchisee applications online through this Website.  If you choose to submit a franchisee application through this Website, we will ask you to provide detailed and verifiable information, including your name, your spouse’s name, your contact information, your Social Security Number, and information about your work and professional experience, your educational background and personal and/or business finances.  In addition, we will ask for permission to conduct a check regarding your credit history, work experience, and general character.  If you do not consent, we will not be able to process your application.  We utilize industry-standard SSL technology to allow for the encryption of all franchisee applications submitted on our Website.  For additional details about our information security practices please see the section entitled SECURITY.   • Electronic Mail:  FRUTATION® may retain the content of any e-mail that FRUTATION® receives, the e-mail address from which it is sent, and our response.  Content and other information in or related to e-mails sent by you to FRUTATION® may be used as testimonials or for other marketing purposes in accordance with the Terms. Please be aware that when you receive a receipt acknowledging your e-mail or your submission of an order or application form, it means that the message or form has been routed into the Internet, and not that it has been received by us.
     
  • Promotions and Sweepstakes:  From time to time, we may offer promotions or sweepstakes on our Website.  When you enter a promotion or sweepstakes, we will require the submission of your name, e-mail address and postal address.  We will use this personally identifiable information for purposes of administering the promotion or sweepstakes in accordance with its rules.  Please note, we may post the name, likeness, and other information about contest winners in accordance with the official promotion or sweepstakes rules (but we do not publish your e-mail or street address information) on the Website and you hereby grant us permission to do so.
     
  • e-Postcards:  From time to time, we also may give you the option to send an e-Postcard to a friend.  An e-Postcard is a fun, easy way for you to electronically share images of an FRUTATION® arrangement or product with someone else.  If you elect to send an e-Postcard, you will be required to provide your name, your e-mail address, and the recipient's name and e-mail address.  You also will be allowed to type in a brief text message.  We will use this information to transmit the e-Postcard and/or a link to the e-Postcard on the Internet on your behalf.  We may use the recipient’s e-mail address to send him or her information regarding us, our products, services, promotions, or upcoming events that we think may be of interest to the recipient.  The recipient can opt-out of receiving such e-mails by following the instructions in any such e-mail.
     

COOKIES AND WEB BEACONS

  • Transaction Requirements:  We sometimes retain the services of franchisees or third parties to perform functions or services on our behalf.  For example, we use service providers to send e-mails on our behalf; and our franchisees may create and ship the FRUTATION® products that you order on our Website.  To our knowledge, these companies do not retain, share, store or use personally identifiable information for any secondary purposes.  However, we do not undertake to confirm, investigate, or police their practices.
     
  • Our Affiliates:  From time to time, we may send your information to our affiliated companies, including NetSolace, Inc., if for example, we believe that they may have information about franchising or other opportunities that may be of interest to you.
     
  • Joint Promotions:  From time to time, we may join with third parties to provide specific services or products.  When users sign up for these services or order these products, we will share only the names and other information that is necessary for the third parties to provide these services or products.  These third parties are not permitted to use personally identifiable information except for the purpose of providing these services or products. However, no security system is impenetrable.  We cannot guarantee the security of our Website or databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.  We ask that you do your part by maintaining any usernames and passwords you use to access the Internet or this Website strictly confidential.

YOUR INFORMATION AND OPTING-OUT
